  • If you create an account on our Site, you are responsible for maintaining the confidentiality of your account credentials, including your username and password.

  • You agree not to post User Content that is:
    • False, misleading, defamatory, libelous, or harassing.
    • Obscene, pornographic, or offensive.
    • Infringing on the intellectual property rights of others.
    • Violating the privacy or publicity rights of others.
    • Illegal or promotes illegal activities.
    • Spam, unsolicited advertising, or promotional materials.
    • Contains viruses, worms, or other malicious code.
  • We reserve the right to remove or disable access to any User Content at any time and for any reason, without notice. We are not responsible for monitoring User Content.

  • You may not reproduce, modify, distribute, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as generally and ordinarily permitted through the Site according to these Terms.
  • Insuraviews and the Insuraviews logo are trademarks of Insuraviews. You may not use these or any other Insuraviews trademarks without our prior written consent.

7. Disclaimer of Warranties

  • THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

  • TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE VALUE OF YOUR SUBSCRIPTION WITH INSURAVIEWS.
  • THE FOREGOING LIMITATIONS AND EXCLUSIONS SHALL APPLY EVEN IF THE REMEDY PROVIDED HEREIN FAILS OF ITS ESSENTIAL PURPOSE.

9. Indemnification

You agree to indemnify, defend, and hold harmless Insuraviews, its affiliates, officers, directors, employees, agents, suppliers, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or access to the Site; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any third-party right, including without limitation any intellectual property right, privacy right, or publicity right.  

10. Termination

We may terminate or suspend your access to all or any part of the Site at any time, with or without cause, with or without notice, effective immediately. Upon termination, your right to use the Site will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law and Dispute Resolution  

  • These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law provisions.
  • Any dispute arising out of or relating to these Terms or the Site shall be exclusively resolved in the state and federal courts located in Milwaukee County, Wisconsin. You consent to the exclusive jurisdiction and venue of such courts.  

12. Entire Agreement

These Terms constitute the entire agreement between you and Insuraviews regarding your use of the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.

13. Waiver and Severability

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect, and the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision.

14. Assignment

You may not assign or transfer these Terms or your rights or obligations under these Terms, in whole or in part, without our prior written consent. We may assign or transfer these Terms, in whole or in part, at any time without notice.
